Without obtaining explicit written consent from Akarigo, you are not permitted to duplicate, alter, distribute, sell or lease any portion of our services.
5.2 You retain ownership of any content you submit through the Services.
However, by submitting content, you grant Akarigo a worldwide, royalty-free, non-exclusive licence to use, distribute, and display such content in connection with the Services.

6. Disclaimer

6.1 THE SITE AND SERVICES ARE PROVIDED “AS IS,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
Akarigo expressly disclaims any warranties of merchantability, fitness for a particular purpose, or non-infringement. Akarigo does not guarantee that the Services will be uninterrupted, secure, or error-free.
6.2 YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.
You assume full responsibility for any damage to your computer system or loss of data that results from using the Site or Services.
6.3 Akarigo makes no warranties regarding the accuracy, reliability, or quality of any information obtained through the Services.

7. Limitation of Liability

7.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Akarigo SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, EVEN IF Akarigo HAS BEEN INFORMED THAT SUCH DAMAGES MAY OCCUR.

7.2 IN NO EVENT SHALL Akarigo’S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR THE SERVICES IN THE PAST 12 MONTHS, OR £100 IF NO PAYMENTS HAVE BEEN MADE.

8. Indemnification

8.1 You agree to indemnify, defend, and hold harmless Akarigo, its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in connection with your use of the Services or violation of these Terms.

9. Governing Law and Dispute Resolution

9.1 These Terms will be governed and construed in accordance with the laws of England and Wales, without respect for conflict of law principles.
9.2 Any disputes arising from these Terms or the use of Akarigo’s Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. General Provisions

10.1 These Terms of Use constitute the entire agreement between you and Akarigo regarding the use of the Services and supersede any prior agreements or understandings, whether written or oral.
10.2 If any provision of these Terms is found to be invalid, the remaining provisions will continue to be enforceable.
10.3 Failure by Akarigo to enforce any provision of these Terms does not constitute a waiver of that provision.
10.4 You may not assign or transfer your rights under these Terms without Akarigo’s prior written consent. Akarigo may freely assign its rights and obligations.
